AN ORDINANCE AMENDING

THE HUDSON COUNTY DISTRICT

SOLID WASTE MANAGEMENT PLAN

INCORPORATING A NEW “CLASS B” RECYCLING FACILITY

            WHEREAS, pursuant to the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq. (“the Act”), the County of Hudson is a designated Solid Waste Management District and, in accordance with law, the Board of  Commissioners (formerly known as the Chosen Freeholders, hereinafter “Board”) adopted the Hudson County District Solid Waste Management Plan (“County Plan”) on April 26, 1979, pursuant to Ordinance No. 167-4-1979, which has been amended from time to time by the Board; and   

            WHEREAS, by Ordinance No. 423-11-1985, the Board designated the Hudson County Improvement Authority (hereinafter “Authority”) as the County Plan’s implementing agency and the Authority has been charged with implementing, updating and amending the County Plan from time to time; and

            WHEREAS, the Authority, at its public meeting of January 10, 2024, duly enacted its Resolution No. 1-2024-7 under the caption:

RESOLUTION OF THE HUDSON COUNTY IMPROVEMENT AUTHORITY RECOMMENDING AN AMENDMENT TO THE HUDSON COUNTY DISTRICT SOLID WASTE MANAGEMENT PLAN FOR INCLUSION OF A NEW CLASS B RECYCLING FACILITY TO BE LOCATED AT THE CARDELLA TRUCKING COMPANY, INC. TRANSFER STATION/MATERIALS RECOVERY FACILITY SITE AT 2400 TONNELLE AVENUE IN THE TOWNSHIP OF NORTH BERGEN, NEW JERSEY

a copy of the Resolution is on file with the Clerk of this Board and available for public inspection, and further, it is made part of this Ordinance by reference; and

WHEREAS, Cardella Trucking Company, Inc. (“Cardella”) filed an application with the Authority on June 7, 2023, seeking an Amendment to the County Plan for the inclusion of a new Class “B” Recycling Facility (the “Recycling Facility”) to be permitted, constructed and operated on properties designated as Block 27.01, Lot 45, Block 55, Lot 1 & 2, on the Tax Map of the Township of North Bergen and more commonly known as 2400 Tonnelle Avenue, North Bergen, New Jersey, adjacent to Cardella’s existing transfer station/materials recovery facility (“TS/MRF”); and

WHEREAS, the Recycling Facility would have operating hours Monday through Saturday from 7 am to 10 pm and utilize previously approved transportation routes for the existing TS/MRF,

and the Recycling Facility would accept a maximum of 2,300 tons per day of source separated recyclable materials, and there will be no on-site processing of such recyclable materials, and

Cardella is the owner and licensed operator of the existing TS/MRF, which is included in the County Plan and is currently permitted by the New Jersey Department of Environmental Protection (“NJDEP”) to accept 800 tons per day of solid waste Types ID 13 and 13C; and

WHEREAS, after careful analysis and evaluation the Authority has prepared a proposed Plan Amendment recommending inclusion of the Recycling Facility into the County Plan, for consideration by the Hudson County Board of Commissioners subject to a hearing and adoption of an ordinance in accordance with the Act; and

WHEREAS, Norman M. You need JavaScript enabled to view it., and copies of the proposed plan amendment documents are available to the public at the offices of the Hudson County Improvement Authority located at 830 Bergen Avenue, Jersey City, New Jersey 07306 and posted on the Authority’s website @www.hcia.org; and

WHEREAS, pursuant to New Jersey Executive Order 23, signed by Governor Philip D. Murphy on April 20, 2018, the Authority has conducted two public hearings with opportunity for public comment regarding the proposed Plan Amendment, and those hearings were conducted in the affected community at the North Bergen Community Center and Library Kennedy Branch, located at 1231 Kennedy Boulevard, North Bergen, NJ 07047, and the Authority received no comments from the public; and

WHEREAS, the Township of North Bergen has provided a letter of support for the facility; and

            WHEREAS, it is the recommendation of the Authority to this Board that the County Plan be amended to incorporate a new “Class B” recycling facility to be permitted, constructed and operated on the properties designated as Block 27.01, Lot 45, Block 55, Lot 1&2, commonly known as 2400 Tonnelle Avenue, North Bergen, New Jersey. 

            WHEREAS, this Ordinance shall replace Ordinance No. 497-8-2024 and will be controlling.

 

            NOW, THEREFORE BE IT ORDAINED, by the Board of Commissioners of the County of Hudson, that:

  1. The County Plan is hereby amended to include the Cardella Recycling Facility, and the aforesaid recitals are incorporated herein as though fully set forth at length.
  2. A copy of the this Ordinance, Hudson County Improvement Authority Resolution No. 1-2024-7, together with a copy of the Plan Amendment shall be available for public inspection at the offices of each Municipal Clerk in the County of Hudson, at the office of the Clerk of the Board of Commissioners of the County of Hudson, and at the Offices of the Hudson County Improvement Authority, 830 Bergen Avenue, Ninth Floor, Jersey City, New Jersey 07306, during regular business hours. Copies shall also be available on the Authority’s website at: hcia.org.
  3. A copy of this Ordinance shall be forwarded to the New Jersey Department of Environmental Protection, Division of Solid and Hazardous Waste, and the Hudson County Improvement Authority, and the Clerk of the County of Hudson.
  4. This Ordinance shall take effect immediately after passage by the Board of Commissioners and approval by the County Executive.
